Terms and Licence Conditions

Conditions for the one-off purchase of GeoGens – Personal Ancient DNA Comparison.

1. Provider and scope

These conditions govern consumer contracts for “GeoGens – Personal Ancient DNA Comparison” with Linus Ammer, trading as Abakos-Systeme, Schönrain 10, 84152 Mengkofen, Germany, email gggeogens.eu.

The purchase contract for the digital product is normally concluded with Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom (registered in England and Wales, company number 8172165); for purchases from the United States with Paddle.com Inc., 3811 Ditmars Blvd. #1071, Astoria, New York, NY 11105-1803, USA, and for purchases from Canada with Paddle.com (Canada) Ltd., Toronto, Ontario, Canada. The entity shown in Checkout acts as reseller (merchant of record) and is the customer's contracting party for purchase, payment, invoicing and refunds. Abakos-Systeme is the maker, developer and licensor of the digital product and performs the service itself. These conditions govern the use and licensing of the product; they do not limit any rights the customer has against the reseller. The entity acting as seller in the individual case is disclosed before the order is placed and on the receipt.

Declarations concerning the contract — in particular a withdrawal — may be addressed either to Abakos-Systeme or to the reseller. Declarations received by Abakos-Systeme are forwarded to the reseller without undue delay; receipt by Abakos-Systeme is sufficient to meet the deadline.

2. Product

The contract covers a one-off, versioned digital DNA comparison: local evaluation of a compatible genome file, a licence file, a machine-readable results package, a readable report and a contract confirmation.

The product is not a subscription, membership or continuously owed analysis or hosting service. Voluntary online features make it easier to use but are not the permanently owed subject matter of the contract.

3. Requirements

  • The purchaser is at least 18 years old.
  • Only the purchaser's own genetic data may be used.
  • The file must have a supported format, recognised genome build and sufficient marker coverage.
  • Initial analysis requires a current supported browser, sufficient memory and local storage and an approximately 2 GB reference download.
  • Insufficient coverage produces a limited or unavailable result, not a guessed result.

4. Formation of the contract

The product presentation is an invitation to make an offer. The customer checks the file locally, gives the required declarations and submits the offer using the final, clearly payment-obligating order button inside the reseller's payment form.

The contract is formed as soon as Abakos-Systeme has verified server-side that payment succeeded. A browser redirect or client-side message is not sufficient.

Without undue delay after the contract is formed, and in every case before the paid analysis begins, Abakos-Systeme supplies the contract confirmation under section 312f of the German Civil Code on a durable medium. Supplying that confirmation is an obligation arising from the concluded contract, not a precondition for its formation.

5. Price and payment

The binding total price is the amount shown immediately before the order is placed, including indirect taxes handled by the merchant of record for the selected market. Each new order takes the current product price from the reseller; a later price change does not alter an order already created. Where local currency is supported, the binding total is shown in that currency.

The reseller determines the available payment methods for the market and device. Payment is one-off.

6. Supply

After verified payment and before paid analysis begins, the customer receives a contract confirmation on a durable medium. The licence and reference access are then supplied and analysis runs solely in the browser.

After successful analysis, a local product package containing the licence, machine-readable evaluation, report, contract confirmation and security guidance is offered for download. The customer is responsible for backing up those files.

7. Licence scope

The purchaser receives a non-exclusive, non-transferable right to use the purchased product release locally on their own devices for an unlimited period and for the same genetic person.

Person matching is performed on genetic characteristics with tolerance for file differences. Identical twins cannot be distinguished technically and count as the same genetic person for this purpose. Use for another person or for third-party genetic data is prohibited.

8. Later releases and online operation

There is no entitlement to future models, reference data, product releases, recalculation, re-download or continued online operation. The customer may use such facilities where offered voluntarily, but this creates no future entitlement.

Mandatory statutory update, security and conformity rights remain unaffected.

9. Loss and replacement

The customer should back up the licence, contract confirmation and results. In the event of loss, contact gggeogens.eu. Reissue is voluntary, subject to receipt and case review, and is not contractually guaranteed. A replaced online access credential may be revoked.

10. Scientific, non-medical purpose

Expressly experimental model validation. Not medical advice or a diagnosis.

The product does not provide disease risk, diagnosis, treatment, medication decisions, paternity or specific relationship tests, or statements for insurers or employers.

The product evaluates genetic similarity to archaeogenetic individuals and culture groups and determines the Y-DNA and mitochondrial haplogroup. Physical, psychological, dietary and performance-related trait models are not part of the contract. The haplogroup assignment places the paternal and maternal line within a reference tree; it is not a kinship, paternity or parentage determination.

11. Local processing and sensitive result files

The genome file, raw calls, scientific results and chosen map position are not transmitted to Abakos-Systeme for analysis. Analysis runs locally in the browser.

The downloaded result package is unencrypted and contains sensitive conclusions derived from genetic data. Anyone who obtains the file can read it. The customer controls storage, backup, disclosure and deletion.

12. Conformity and updates

Statutory rules for digital products apply. Abakos-Systeme supplies security and functional updates required for conformity for the legally required period. These terms do not restrict mandatory consumer rights.

13. Liability

Abakos-Systeme has unlimited liability for intent and gross negligence, injury to life, body or health, applicable product liability and expressly assumed guarantees.

For slight negligence involving an essential contractual duty, liability is limited to the foreseeable loss typical of the contract. Essential contractual duties are those whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely.

Other liability for slight negligence is excluded to the extent permitted by law.

14. Withdrawal

Consumers in the EU, EEA, Switzerland and the United Kingdom generally have a fourteen-day statutory right of withdrawal. For digital content not supplied on a tangible medium, it is lost only after the customer expressly requests performance before the period ends, acknowledges the loss, receives a durable contract confirmation and performance begins.

Australia and New Zealand do not provide a general statutory return right for this online purchase merely because the customer changes their mind. Mandatory rights for faulty or non-conforming digital products under the Australian Consumer Law or the New Zealand Consumer Guarantees Act and Fair Trading Act remain fully effective.

Canada has no single nationwide general cancellation right for this purchase merely because the customer changes their mind. All mandatory rights of the purchase province remain unaffected, including rights where pre-contract disclosures, an opportunity to correct errors, a timely contract copy or timely supply were not provided.

Where a right of withdrawal applies, it may be exercised through the continuously available electronic function or the channels stated in the Withdrawal Information.

15. Refunds

A buyer will receive a full refund if they request it within 14 calendar days of purchase. For consumers in the EU, EEA, Switzerland and the United Kingdom, the digital-content exception described in section 14 applies. Statutory refund rights remain unaffected. Full rescission revokes the online entitlement. Locally downloaded files cannot technically be erased remotely and may no longer be used after rescission.

16. Law, language and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice does not remove mandatory protection under the law of their habitual residence.

Contract languages are German and English. Abakos-Systeme does not voluntarily participate in consumer arbitration.

17. Australia and New Zealand

For customers habitually resident in Australia, no term excludes non-excludable consumer guarantees or remedies under the Australian Consumer Law. The corresponding rule applies to the Consumer Guarantees Act and Fair Trading Act for customers habitually resident in New Zealand.

Genome processing remains on the user's device. Only the order and payment data identified in the Privacy Information is processed across borders.

18. Canada

For Canadian purchases, the provider identity and contact address, product description and system requirements, price, tax, currency, payment terms, start of supply, cancellation and refund policy and all other restrictions are displayed clearly and in a retainable form before ordering. Immediately before contract formation, the customer can correct the entries and accept or decline the contract.

The purchaser name is collected only for Canadian orders. A copy of the contract is supplied on a durable medium within fifteen days and in practice before paid analysis begins. Statutory notices may be sent by email to Abakos-Systeme or Paddle; all mandatory provincial or territorial cancellation and refund rights remain unaffected.

The genome file and genetic test results are not disclosed to Abakos-Systeme. Local analysis starts only after a separate, expressly accepted consent whose wording and timestamp are recorded.

19. Versions and severability

Each purchase is governed by the version displayed during ordering and embedded in the contract confirmation. Later changes do not alter completed contracts retroactively.

If a term is invalid, the remaining terms and mandatory statutory rights are unaffected.
